Issuing Building Permits

A recent reminder from the Victorian Building Authority was made about building permits. Building surveyors are being reminded to comply with the requirements, specifically in the Building Act 1993 in the sections 24A and 24B. Before applying for business permit, it is important that the name of the builder on the contract and insurance certificate, which would be provided by an insurer that issued the required insurance, should be the same or identical. This will be checked by the building surveyors and would verify whether the names are identical with the use of the extract of the contract and the copy of insurance certificate. This is in accordance with 36A of the Building Regulation 2018. The aim of this requirement is to protect the interests of property owners in Australia because building surveyors are expected to ensure that the name of the builder on the contract and on the requisite and warranty insurances. The Domestic Building Contract Act 1995 required all major domestic contracts their registration number. Here’s the inclusion of registration numbers: the builder, in the case of a natural person; the partners who were registered, in the case of a builder trading as a partnership; and the directors who were registered, in the case of a builder trading as a corporation. From July 1 of 2018, it is a requirement that the building registration number and/or the Australian Company Number must be specified by those body corporates that are party to a major domestic building contract. Furthermore, it is a requirement that the major domestic contract state the names and the addresses of each of the members if the builder will carry out work on behalf of a partnership.
